Consider an ordinance amending the City of Baytown's official zoning map to rezone approximately 131 acres generally located west of Garth Road, on both sides of West Cedar Bayou Lynchburg Road, and east of John Martin Road including multiple parcels, all within Baytown, Harris County, Texas, from an Open Space/Recreation (OR) Zoning District to a General Commercial (GC) Zoning District.
PREFACE

In 2017 the City unilaterally annexed a number of parcels that are generally located west of Garth Road, on both sides of West Cedar Bayou Lynchburg Road, and east of John Martin Road. The City is now taking the initiative to rezone a portion of this area from an Open Space/Recreation (OR) Zoning District to a General Commercial (GC) Zoning District.

In 2018 the city received two (2) zoning map amendment applications (ZMA) to allow General Commercial (GC) zoning district along West Cedar Bayou Lynchburg Road.  The City recognized West Cedar Bayou Lynchburg Road and John Martin Road as an area transitioning into commercial. In addition, City Council approved a Future Land Use Plan (FLUP) amendment in January 2019, that designated this area as Commercial Corridor. The proposed ZMA is consistent with the FLUP and consistent with the ZMAs approved in 2019.

In an effort to increase transparency, this City sponsored ZMA had three (3) public hearings with Planning and Zoning Commission, two (2) additional mailed notifications, and each occupied structure received a door hanger prior to the last public hearing held by Planning and Zoning Commission with information about the January 21st, 2020 public hearing as well as contact information if they had any questions. During the course of the public hearings, a need was identified to increase flexibility for properties that were developed for residential use prior to annexation. This required a text amendment of the ULDC. The ZMA was paused in order to allow both items be considered by City Council together.

Two (2) individuals, both property owners within the ZMA  subject area, spoke at a Planning and Zoning Commission public hearing; one (1) individual was in favor of the ZMA and the other requested additional information. Additionally, two (2) other individuals contacted staff; neither had concerns with the ZMA.

The Planning and Zoning Commission recommends approval.
