Variance - Reduced Frontage

Consider approving a request for a subdivision variance to have a reduced frontage on an improved public right-of-way (ROW), located at 3709 Morelos Road, approximately five (5) acres, legally described as West 1/2 of Lot 32, Block 23, Highland Farms, Harris County, Texas.
The subject property is located within the extraterritorial jurisdiction (ETJ) of the City of Baytown. The applicant would like to subdivide his property into three lots to construct two additional homes and is requesting a variance from the City of Baytown code of ordinances Sec. 126-551 that requires the minimum lot width to be 50 feet. Chapter 126-219 also states that a variance to this chapter may be granted if the property is in the ETJ and meets the minimum county standards. In addition to city approval, this subdivision will be required to obtain County Commissioners Court approval.
The Unified Land Development Code currently permits 20 foot flag lots within the city limits for residential development. The applicant is requesting to meet the same standards that are permitted in the city limits. The applicant is proposing two lots with 10 feet of frontage on each flag to provide access for two lots with a total frontage of 20 feet. The twenty (20) feet providing access to Morelos Road is contained in an access easement which is constructed with 10 feet from each property. The third lot will meet the 50 foot lot width requirement (refer to the attached plat).
